These terms govern the sale of photographic prints, digital/stock photographs, and photography workshops/courses through the website [jacopoursitti.com] ("the Site"), operated by:
[Jacopo Ursitti] – Sole proprietorship – VAT number [insert VAT number] Registered address: [Via B.Virgilio 46, Villetta Barrea (67030), Italy] Email: [jacopoursitti@gmail.com]
1. Products and services offered
Photographic prints: physical reproductions of nature photographs, shipped to the address provided by the customer.
Digital photographs / stock images: high-resolution digital files, made available for download after payment.
Photography workshops and courses: in-person or online learning experiences, with a limited number of participants.
All prices shown on the Site are in euros (€) and, where applicable, include VAT.
2. Shipping of physical prints
Physical prints are shipped within Italy and worldwide.
Shipping times vary depending on the destination: approximately [5-7 business days] for Italy and [7-15 business days] for international orders. These times are estimates and not binding.
Shipping costs are calculated based on the weight/size of the print and the destination, and are shown to the customer before the order is finalized.
Risk of loss or damage to the product passes to the customer upon delivery to the carrier/shipping provider.
For shipments outside the EU, any customs duties or local taxes are the responsibility of the recipient.
3. Delivery of digital content
Purchased digital photographs/stock images are made available for download immediately after payment is confirmed, via a personal download link or a dedicated area of the Site.
It is the customer's responsibility to download and keep a copy of the purchased files; the Owner does not guarantee the availability of the download link beyond [insert period, e.g. 30 days] from the date of purchase.
4. Right of withdrawal
4.1 Physical prints
Under Italian and EU consumer protection law, the customer has the right to withdraw from the contract within 14 days of receiving the product, without needing to provide a reason, unless the print was customized at the customer's specific request (e.g. custom size or medium), in which case the right of withdrawal is excluded pursuant to Article 59 of the Italian Consumer Code.
4.2 Digital photographs/stock images
Although digital content not supplied on a physical medium could, under the law, have the right of withdrawal excluded once the customer expressly consents to immediate delivery, the Owner nonetheless grants customers a 14-day right of withdrawal from the date of purchase. In this case, the customer agrees to delete every copy of the downloaded file and to make no further use of it, on penalty of forfeiting the right to a refund.
4.3 How to exercise the right of withdrawal
To exercise the right of withdrawal, the customer must send a written notice to jacopoursitti@gmail.com within the stated deadline, specifying the relevant order. The refund will be issued using the same payment method used for the purchase (PayPal), within 14 days of receiving the request.
5. Photography workshops and courses
5.1 Booking and payment
A workshop/course booking is considered confirmed once payment has been made via PayPal. The number of spots is limited and assigned on a first-come, first-served basis.
5.2 Cancellation by the customer
Cancellation terms for the customer (deadlines and any applicable fees) are specified on the individual page of each workshop at the time of booking.
5.3 Cancellation or postponement by the organizer
In the event of bad weather or other circumstances preventing the workshop from taking place (including safety conditions related to the nature photography activity), the Owner reserves the right to cancel or postpone the event. In such cases, participants will be offered a new makeup date, with no entitlement to a cash refund. The Owner will promptly communicate any cancellation and the alternative dates available.
5.4 Liability
Participation in workshops, particularly those held outdoors in natural environments, involves accepting risks associated with outdoor activity (terrain, weather conditions, wildlife). Each participant is required to follow the safety instructions provided by the Owner.
6. Usage rights for purchased photographs
Purchasing a print or a digital file does not transfer copyright in the photographic work to the customer; copyright remains with the Owner.
Unless otherwise agreed in writing, the purchase grants the customer a personal, non-commercial license to use the work (e.g. printing for private use, use as a wallpaper/background). Any commercial, editorial, or resale use requires a specific license to be separately agreed with the Owner.
7. Payments
Payments are processed exclusively through PayPal. The Owner does not have access to, or store, the customer's payment card details, which are handled directly by PayPal in accordance with its own privacy policy.
The order is considered confirmed only after payment has been confirmed by PayPal.
8. Defective or damaged products
If a print is damaged in transit or is defective, the customer must report it within 7 days of delivery to jacopoursitti@gmail.com, attaching photos of the damage. The Owner will, at its discretion, replace the print or issue a refund, at no additional cost to the customer.
9. Governing law and jurisdiction
These terms are governed by Italian law. For disputes involving consumer customers, the competent court is that of the consumer's place of residence or domicile, in accordance with the Italian Consumer Code.
